    Its risky to change job (other than same or similar) using AC21 Rule:

    Here's an extracts from Shusterman.

    "To determine whether the new job is the same or similar to the old job, the USCIS consults the Labor Department Dictionary of Occupational Titles (DOT) or the online O*NET Classification System (one of the two), or similar publications. The memo prohibits INS officers from denying I-485 based on failure to demonstrate that the new job is in the same or a similar occupation as the initial job unless they have consulted, on a case-by-case basis with USCIS headquarters."

    When will Jan 2007 become current?

    ROW?
    China?
    Mexico?
    Philippines?
    India?

    EB1 is current for all
    EB2 is current except for China (1 Jan 03) but India is unavailable.
    EB3 varies bewteen Apr 01 and Nov 02 depending on the area


    roll on 1st March for new dates to be effective.

    for_gc,

    once bill becomes law, USCIS will have to implement it immediately, else they will be breaking the law. there probably is a way for them to go to court and ask for more time by citing administrative delays.

    The time and efforts put in by these core members is unknown to many of us; but as sensible and logical thinking persons can easily visualize that.

    Their cause is great and we must all support. Each of us could face small and trifle matters, but don't blow it out. Be magnanimous.

    India does have deduction from your paycheck: its the EPF/ PF (Employee Provident Fund/ Provident Fund).

    You can manage your own pension fund - its called the PPF.

    EPF/PF don't allow withdrawals until you retire (i think its driven by age - 62years for men; 55 for women - but i'm guessing here)

    Its not the same as social security. Its a little bit better because you pay for your own retirement and not for anyone elses.

    nope, so far I have not come across a single case where this has been an issue (which was one reason I went ahead with the move). However there have been inklings about USCIS possibly taking a tougher position on this in the future.

We are also asked what "same or similar" really means in order for one to be eligible under AC21 portability. USCIS policy memoranda, particularly the May 12, 2005 Memo referenced above, have been quite favorable on these matters. However, in that same memo, the USCIS stated that the forthcoming AC21 regulations "may take a more restrictive position than this memorandum." Therefore, while issues such as salary differences do not appear to be problematic at present, foreshadowing indicates that this could change when the regulations are released at some future date.

    From my research I have found so far that it will be hard for them to put a dollar or percentage figure on the amount the salary can vary. The best they can do is perhaps put it in some range based on prevailing wages. Other than that, salary itself is a very market driven thing. I hope they dont, and I dont think it buys them much. The DOT codes and job-duties description should be what they should look at (or actually they should broaden the allowed job changes considering how long the wait has become now-a-days).

    Lets see what happens. Main trouble is like what Murthy mentions in that article a little later: if changes happen, they are retroactive...

    My point was that it doesn't matter. It represents $1000/ per person, hardly enough to make a dent in poverty. We need sensible labor laws, a pro-business attitude, and that money will return to India.

    Dude, with all due respect, thats a LOT of money. Almost 3% of world GDP is a heck of a LOT money.

    I think you make some very good point about funding. I see some people complaining how a lot of members aren't contributing. I think it is plain naive to expect everyone to contribute.
    People can be divided into three types:
    1. People willing to fight what they percieve as injustice.
    2. People who complain but do nothing about what they think is unjust.
    3. People who accept injustice as part of life.

    This isn't just about immigration. It could be any issue. Most ppl want someone else to do what's needed. They don't want to spend time or money. There will always be a few ppl who are active. If you belong to category 1, don't expect everyone to belong there.

    The other aspect IV should consider is broadening the goals. IV has done good work but the core focus seems to be retrogression. Tens of thousands of ppl have cases rotting in BEC for 3-5 years they are not going to contribute to an organization that will put them at par with ppl who filed for labor in the last couple of years. It goes against human psychology.

    Just my 2 cents....

    First off - I have contributed, but here is an explanation of my initial reluctance to do so and possibly why I haven't contributed more than I have, since you asked.

    I have often been offended by the tone and bias on this board, when it is plainly evident that the majority of power posters think their own situation as being the only thing that should be resolved, alienating others as a result.

    Don't tell me to donate by spending less money on stuff that culturally I never do, or refer to people that I know little about - all for cultural reasons. It was this thread that spurred me to contribute, and ironically, this thread that also offended me first. I still haven't forgotten that.

    Wonder how else you alienate people? Try posting in a language that isn't English.

    Regarding the recent pledge drive in particular, it gives me a nasty taste in my mouth since it stings of hypocrisy that I can't get over. A similar one was attempted by a member here (which I signed up for), using the ""I will donate $10 monthly to Immigration Voice for one year but only if 1,000 other people will do the same."

    That effort, although endorsed by the core group, got 88 people to vote, and was criticized in these very forums as being a waste of time, or not the proper way to do it. Of course, fast forward a few months and now look...

    I also find it distasteful to have to read through threads that could be of some importance or value, but find that good chunks are just "Hey, look at me, look at how much I contributed"

    So, since I'm all bitter and alienated , why did I actually contribute?
    Every time I get annoyed or offended by someone's insensitive or cultural narrow mindedness, I try to ignore it and remind myself that that single person does not represent the values of the core group and this organization as a whole. It gets challenging.

    When I was hired last spring, I was not told about GC retrogression by my employer. I beleive they should have explained in graphic detail and if they done so I would not have left a good job and my home in Canada to move to an American nightmare.

    I recently discovered that I have at least a 5 year wait as an EB-3. My teenage daughter will be too old to get a green card as a dependent and my wife is seriously depressed about not being allowed to work.

    How many other people are as P-Oed as I am and is there a class action suit here?

    I recently added pages to my passport in India while I was in Vaccation. It was painless process as I went through travel agent and have to pay extra money. No police verification is required if your renewing. Adding pages/renewal is all the same process.

    If you apply in Tatkal, you will get your passport in a week. If you do in India, I advice you go through some travel agent.

    Did not renew here as my job requires frequent travel at short notice.

    If you are not travelling internationally then it is best to do it USA.

    Once you used EAD your status is AOS. You can't go back to H4/H1 unless some bad thing happened like 485 is denied.
    once started usign EAD you can't go and come on H4/H1 status...
    you have to use AP for travelling. If you have a doubt talk to the atternoy that filed your 485.

    I also don't think this is true. After you get your 3-year H1B extension beyound the 6-year limit and say your 485 gets denied while you are in 7th year, you can still stay and work for the rest of the 2 years on your H1B and use those 2 years to file for new LC etc.

    Gurus, please advise, with the slew of mistaken 485 denials this is an important point to clarify.

    He will have the H1 status until the expiry date. But only thing he may not be able to transfer H1 if there is no other case is pending.

    Friends I think a great injustice is being done to NSC filers , their applications are taking months for ead and ap, while TSC filers are getting ead adn AP as soon as they get receipt, do you think this will improve for NSC in future, at this time looks like august NSC filers will haveto wait till the end of the year for EAD,ap, which is sad.

    Cant beleive you said that ! Just think how it feels to be waiting for receipt notices, knowing people who filed in late June are still getting them (and only a couple of July 2nd filers so far)and also knowing that if something is wrong with ur application, its going to take years before you can apply again....and compare it to the additional 2 months u r going to wait for ur EAD/AP

    applied on 29th june
    reached on 2nd july TX.
    our checks got cleared on 15th AUG.
    on 17th our i-765(EAD)-status changed to card production ordered.
    but we are waiting of our receipt and FP notice

    You will get your card between 5 to 10 days from the date you have recieved card production email, so you will have time to go India and get the marriage certificate.

    I've been thru many jobs here, and none of the offer letters mentioned that the job would be "permanent" (whatever that means). It's especially not possible to have that written on job offer letters for contract/project-based jobs. In any case, UDCIS does *not* require you to mention that on your EVL.
